Terms of Service

These Terms govern your access to and use of the QuanticData website, dashboard, proxy networks and APIs (the "Service"). By creating an account or using the Service you agree to these Terms. If you use the Service for an organisation, you confirm you are authorised to bind it.
1. The Service
QuanticData provides proxy networks and pay-per-success web data APIs (search, scraping, crawling, mapping, SEO audit and related tools). We may change, add or remove features; we will give reasonable notice of material changes that adversely affect a paid feature you rely on.
2. Accounts
You must provide accurate information and keep your credentials and API keys secure. You are responsible for all activity under your account and keys. Notify us promptly of any unauthorised use. One person or organisation per account unless agreed otherwise.
3. Acceptable use
You agree to use the Service only for lawful collection of publicly accessible data, and not to:
- access data behind a login, paywall or authentication you are not authorised to use, or bypass access controls or CAPTCHAs on accounts;
- collect or process personal data without a lawful basis, or in breach of privacy laws;
- infringe intellectual property, breach a site's binding contractual terms where those apply to you, or facilitate fraud, spam, malware or attacks;
- resell or redistribute raw access in a way that circumvents our billing, or exceed documented rate limits deliberately;
- use the Service to harm, harass or surveil individuals.
You are solely responsible for the targets you choose, the data you collect and how you use it. We may suspend accounts that breach this section.
4. Billing and pay-per-success
- Usage is billed per successful result at the unit prices shown on the site and in your dashboard. Failed calls — blocked pages, captchas, timeouts and internal retries — are not billed, and asynchronous crawl and batch jobs automatically refund pages that could not be fetched. These automatic credits are the core of how billing works — you are only ever charged for usable results.
- Every account includes a monthly free allowance; beyond it you pay from your prepaid balance or subscription. Subscriptions renew until you cancel.
- Prices exclude taxes unless stated; applicable taxes (e.g. VAT) are added at checkout.
5. Refunds
Except where the law requires otherwise, and apart from the automatic pay-per-success credits described above, fees are non-refundable. In particular:
- Prepaid balance is spent against usage and is non-refundable; unused balance does not expire but is not returned as cash.
- Subscription fees are charged for the billing period and are not refunded when you cancel; cancellation stops the next renewal.
- Per-IP proxy rentals (for example ISP proxies) are non-refundable once the IPs are provisioned or the rental period has begun.
Where we are at fault — a genuine service failure on our side — we may, at our discretion, credit your account. Any promotional trial or money-back offer, if we run one, applies only on the specific terms stated in that offer. Consumers keep any statutory withdrawal or refund rights that apply in their country.
6. Your data and ours
You retain all rights to the data you collect through the Service; you grant us only the limited rights needed to operate it. We handle personal data as described in our Privacy Policy. We own the Service itself, our software, brand and documentation.
7. Availability
We aim for high availability but do not guarantee the Service will be uninterrupted or error-free unless a separate SLA applies to your plan. We may perform maintenance and will try to minimise disruption.
8. Suspension and termination
You may close your account at any time. We may suspend or terminate access for breach of these Terms, non-payment, or where required by law or to protect the Service or third parties. On termination your right to use the Service ends; sections that by nature survive (e.g. billing owed, liability, governing law) continue.
9. Warranties and disclaimer
The Service is provided "as is" and "as available". To the extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that any specific target will be accessible or that results will be complete.
10. Limitation of liability
To the extent permitted by law, neither party is liable for indirect, incidental or consequential damages, or lost profits or data. Our total liability for any claim is limited to the amount you paid us for the Service in the three months before the event giving rise to the claim. Nothing limits liability that cannot be limited by law.
11. Indemnity
You will indemnify us against claims arising from your use of the Service in breach of these Terms or of applicable law, including claims relating to the data you collect or how you use it.
12. Changes to these Terms
We may update these Terms and will revise the date above; material changes will be notified in the dashboard or by email. Continued use after changes take effect means you accept them.
13. Governing law
